The initiative has provoked a reaction from Polish pro-life organizations and has already reached the Public Prosecutor’s Office.
The Ordo Iuris Institute has filed a complaint with the Warsaw-Śródmieście District Prosecutor’s Office regarding BioTexCom’s activities and has requested an investigation into whether organizing these programs could constitute, among other possible crimes, illegal adoption or preparation for human trafficking.
The organization also calls on Polish authorities to prevent the event from taking place.
Packages of up to €64,900
BioTexCom, a Ukraine-based company specializing in assisted reproduction and surrogacy, has announced a series of meetings in the Polish capital this weekend aimed specifically at potential clients.
The company offers individual consultations in which it presents its surrogacy programs. According to the information released about its offerings, prices range approximately between €37,000 and €65,000 euros.
The most expensive package reaches €64,900.
The company also has a website and communication channels in Polish to attract clients. Its services include various stages of the reproductive process and, according to Ordo Iuris, range from the selection of the surrogate mother and assisted reproduction procedures to pregnancy coordination, childbirth, and the subsequent delivery of the child to those who contracted the program.
It is precisely the commercial nature of the meeting that has led its detractors to call it a «baby fair.» BioTexCom, on the other hand, presents it as a conference and an opportunity to hold consultations about its programs.
Ordo Iuris takes the case to the Prosecutor’s Office
The announcement has triggered a legal reaction in Poland. Ordo Iuris filed a complaint on September 2 with the Warsaw-Śródmieście Prosecutor’s Office, considering that there are sufficient indications to investigate the company’s activities.
The Institute maintains that the process offered by BioTexCom could allow the child born through surrogacy to be delivered to clients while avoiding the adoption procedure established by Polish law.
The complaint raises three possible criminal categories: illegal organization of adoptions, preparation for human trafficking, and participation in an organized criminal group. These are, for the moment, allegations made by Ordo Iuris that must be examined by the authorities, not crimes declared by a court.
The organization has requested the opening of proceedings and that documentation and electronic data related to the meeting scheduled for the 12th and 13th be secured.
A request to prevent the meeting
At the same time, Ordo Iuris has promoted a petition addressed to the authorities requesting that the event be blocked.
«The conference that the Ukrainian company is planning for September in Warsaw is not a neutral informational event, but a promotional campaign for a commercial reproductive business,» the Polish organization maintains.
The Institute considers that this model turns the woman’s body into an instrument to satisfy the order of third parties and the child into the object of a commercial transaction.
In recent years, Ordo Iuris has argued before international bodies that commercial surrogacy should be addressed from the perspective of the sale and trafficking of children.
The organization has taken this position before the United Nations and European institutions and proposes the adoption of an additional protocol to the Convention on the Rights of the Child that expressly prohibits surrogacy.
Surrogacy and the dignity of women and children
The Polish controversy comes amid a growing international debate on surrogacy and its consequences for surrogate mothers and children.
The Catholic Church maintains an unequivocally opposed position to this practice.
The declaration Dignitas infinita, published in 2024 by the Dicastery for the Doctrine of the Faith, states that surrogacy gravely violates the dignity of women and children and recalls that the latter has the right to a fully human origin and not one artificially induced.
The document particularly denounces the transformation of the child into the object of a contract and maintains that the legitimate desire to have offspring cannot become a «right to a child.»
The rejection was also expressed with particular force by Francis, who in January 2024 called on the international community to work for a universal ban on surrogacy.
The meeting is scheduled for this weekend
Unless Polish authorities intervene beforehand, BioTexCom’s promotional meetings are scheduled for September 12 and 13, that is, this coming weekend.
The announcement is particularly significant because it is being held in Poland, a country where surrogacy lacks a specific legal framework that would allow it to operate as in Ukraine.
Ordo Iuris maintains that certain actions related to the paid delivery of children may conflict with various provisions of Polish criminal law.
The complaint filed with the Prosecutor’s Office thus elevates the conflict beyond ethical controversy: the authorities must now determine whether there are legal grounds to investigate BioTexCom’s activities and, in the meantime, organizations opposed to surrogacy maintain their request that the meeting not take place.
