Eviction action against schismatic Poor Clares: Court date postponed

Is this a last glimmer of hope for the schismatic Poor Clares in Belorado, Spain, who are threatened with eviction from their convent

The hearing scheduled for next week has been postponed by the competent court, the Archdiocese of Burgos, in whose territory the convent is located, announced on Thursday. 

The reason given by the court was that it had not been possible to serve the official summonses to the excommunicated nuns and other persons who are said to be staying on the monastery grounds without authorisation. 

As soon as this had been done, a new date would be set. 

However, according to the archdiocese, the court is maintaining 23 January as the date for the eviction.

The fact that it is not possible to deliver a letter to cloistered nuns because it is not known where they are caused irritation at the Spanish magazine "Vida Nueva"

According to lawyers specialising in tenancy law, "disappearing from the scene" is common behaviour in the squatter scene in order to delay a court decision on the eviction of a property, according to the magazine, which specialises in ecclesiastical issues. 

As an example, "Vida Nueva" cited the possible sending of some sisters to the convent in Orduña, which belongs to the main monastery of the Poor Clares in Belorado.

Eviction action also for convent in Derio

The Archbishopric of Burgos also announced that the competent court in Bilbao had also accepted an eviction suit for the convent in Derio, which belongs to the schismatic Poor Clares. Anyone staying there without authorisation would have to leave the monastery grounds. 

The ex-clares now have ten days to lodge an appeal against this decision. According to media reports, the convent in Derio has been uninhabited since the start of the coronavirus pandemic in 2020. 

It made headlines a few days ago because the nuns claimed to have experienced demonic activity there a few years ago.

In May, the Poor Clares of Belorado had joined a schismatic bishop and thus renounced the Catholic Church. 

In the months that followed, they were excommunicated and placed under the authority of another schismatic bishop, who is currently said to be staying in the monastery in Belorado with some of his followers without authorisation.

In view of the impending eviction, the schismatic Poor Clares have declared that they do not want to leave the convent. 

It is possible that the archbishopric of Burgos will push ahead with the eviction of the convent, as it is not the private property of the schismatic sisters, but church property. 

Attempts by the former Poor Clares to convert the convent into an association under civil law and thus retain control of the building have previously failed.
