Woman's suit against priest settled out of court

A Brookville woman's lawsuit accusing a pastor at a West Milton Roman Catholic church of sexual harassment has been settled out of court.

A notice dismissing the civil action by Tracy Simon against the Rev. John MacQuarrie of Dayton, Transfiguration Church of West Milton, the Archdiocese of Cincinnati and Archbishop Daniel Pilarczyk of Cincinnati was filed in Miami County Common Pleas Court.

Simon filed the suit in spring 2006 in Montgomery County contending she was the subject of sexual advances by MacQuarrie while she was employed by the church. She further contended she filed a complaint with the archdiocese before she was fired in October 2005. She sought more than $25,000 in damages.

MacQuarrie denied the allegations in 2006.

The suit was transferred in late 2006 to Miami County, where the Transfiguration Church is located.

Simon's lawyer Frank Payson of Dayton said he could confirm the suit's dismissal, but could not comment on any settlement agreement.

The attorney for the defendants, Robert J. Reid of Cincinnati, said he had no comment on the case.

The dismissal notice said court costs would be paid by the defendants.
